Introduction: DMCA Policy

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification should include:

  1. Identification of the material: The material that was removed or disabled and the location where it appeared before removal.
  2. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Contact Information: Your name, address, telephone number, and email address.
  4. Statement of Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside of the United States, for any judicial district in which Digitalk365 may be found, and that you will accept service of process from the person who provided the DMCA notice or an agent of such person.
  5. Signature: Your physical or electronic signature.

Termination of Repeat Infringers

In appropriate circumstances, Digitalks365 may terminate the accounts of users who are repeat infringers.
